Terms of Use & Service

Terms governing use of ProGrill.com and Pro Grill cleaning, inspection, repair, maintenance, parts, installation, grill sales and related services.

Please read these Terms carefully. By accessing or using this website, booking a service, approving an estimate, purchasing a product, or otherwise doing business with Pro Grill, you agree to these Terms to the extent permitted by applicable law.

1. Acceptance of These Terms

These Terms of Use & Service (“Terms”) are a legally binding agreement between you and Pro Grill Cleaning, Inc. (“Pro Grill,” “Company,” “we,” “us,” or “our”). “You” and “your” mean the individual or entity using the website or purchasing or receiving our products or services.

If you do not agree with these Terms, do not use the website or purchase or receive services from us. If you are accepting these Terms on behalf of a business, homeowners association, property manager, employer, or other organization, you represent that you have authority to bind it.

2. Scope; Other Agreements

These Terms apply to ProGrill.com and to Pro Grill services and transactions unless a more specific written agreement, estimate, work order, invoice, product warranty, promotion, financing agreement, membership agreement, or other contract applies to the same subject.

If there is a conflict, the more specific agreement controls for that subject. The Protection Plan Terms & Conditions govern the Pro Grill Protection Plan. Manufacturer warranties and third-party financing terms are governed by their respective providers.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to purchase services or products from us. You are responsible for providing accurate contact, billing, service-location, grill, access, and other information reasonably needed to perform the requested work.

4. Website Use

You may use this website only for lawful personal or business purposes. You may not interfere with the website, attempt unauthorized access, introduce malicious code, bypass security measures, scrape or harvest information in a manner that materially burdens our systems, impersonate another person, or use the website in a way that violates applicable law or the rights of others.

We may suspend or restrict access to the website when reasonably necessary for security, maintenance, legal compliance, misuse prevention, or protection of our users, systems, or business.

5. Quotes, Estimates, Pricing & Availability

Website pricing, promotions, estimates, product descriptions, availability, and appointment windows may change. Unless expressly stated otherwise, a quote or estimate is based on the information available when it is provided and may change if the grill, installation, site conditions, requested scope, required parts, labor, access, or other material circumstances differ from what was represented or reasonably anticipated.

Taxes, delivery, installation, special-order parts, island modifications, gas or electrical work, disposal, permits, specialty labor, and other charges are not included unless expressly stated. We will seek your authorization before performing material additional chargeable work whenever reasonably practicable.

We may correct typographical, pricing, or availability errors and may decline or cancel an order or service request that resulted from an obvious error, subject to applicable law and any payment already collected.

6. Booking, Appointment Windows & Scheduling

Online booking requests are subject to confirmation. Requested dates and times are not guaranteed until confirmed by Pro Grill. Arrival times may be provided as windows because travel, prior jobs, traffic, weather, parts availability, access issues, and unexpected field conditions can affect the schedule.

We may reschedule, reassign, shorten, pause, or discontinue an appointment when reasonably necessary for safety, weather, technician availability, inaccessible property, hazardous conditions, incorrect service information, unavailable parts, or other circumstances outside our reasonable control. When appropriate, we will work with you to arrange another appointment.

7. Payment Authorization & Amounts Due

You agree to pay the prices, fees, taxes, parts charges, approved additional work, and other amounts disclosed to you in connection with your purchase or service. By providing a payment method, you represent that you are authorized to use it and authorize us and our payment processors to charge amounts that are due under your booking, estimate, work order, invoice, membership, or other agreement.

Unless otherwise agreed in writing, payment is due when stated on the applicable invoice, estimate, booking confirmation, or work order. Failed or reversed payments may result in suspension of future service and may be subject to lawful collection costs or fees where permitted.

8. Cancellations, Rescheduling & Missed Appointments

Our technicians reserve appointment time specifically for your service. Unless different terms are disclosed at booking or required by law, cancellations or rescheduling requests made fewer than 72 hours before the scheduled appointment may be subject to a $199 cancellation or late-rescheduling fee.

A similar fee may apply if we cannot reasonably perform the scheduled work because we cannot access the property or grill, the grill is unavailable, required utilities are unavailable, unsafe conditions exist, or material information provided when scheduling was inaccurate or incomplete.

Special-order parts, custom items, deposits, memberships, and promotional purchases may have separate cancellation or refund terms disclosed at purchase. Nothing in this section limits any cancellation, refund, or cooling-off right that cannot legally be waived.

9. Customer Responsibilities & Property Access

You agree to provide a reasonably safe and accessible work area and to:

  • Provide accurate gate, parking, access, contact, and appliance information.
  • Ensure pets, children, guests, and other hazards are kept away from the active work area.
  • Provide access to utilities reasonably required for the scheduled service when applicable.
  • Disclose known gas leaks, electrical issues, fire damage, pest activity, structural damage, prior modifications, or other hazardous or unusual conditions.
  • Obtain any permission required from an owner, landlord, association, property manager, or other responsible party before authorizing work.
  • Remove valuables, fragile property, and unrelated personal items from the immediate work area.

10. Grill Cleaning Services

Professional grill cleaning is intended to remove accessible grease, carbon, food residue, and buildup from applicable grill surfaces and components within the scope of the service purchased. Cleaning is not the same as factory-new restoration, refinishing, resurfacing, rebuilding, repair, or replacement.

Permanent staining, discoloration, oxidation, corrosion, pitting, heat marks, burned finishes, scratches, rust, aged enamel, damaged coatings, and other wear may remain after cleaning. Results vary based on grill age, materials, condition, prior maintenance, exposure, use, and manufacturer construction.

If a grill has severe buildup, infestation, hazardous contamination, extensive corrosion, inaccessible areas, unsafe components, or other conditions outside the scheduled scope, we may recommend additional work, modify the service, or decline to proceed. Any additional chargeable work is subject to your approval where required.

11. Inspection, Diagnosis & Repair Services

An inspection or diagnosis reflects the conditions reasonably observable and testable at the time of service. It is not a guarantee that every existing or future defect will be discovered. Intermittent faults, concealed defects, inaccessible components, supply problems, manufacturer design issues, and failures that occur after inspection may not be detectable during the visit.

Repair recommendations are based on available information, parts availability, safety considerations, and professional judgment. Approval of a repair does not guarantee that unrelated components will not fail later. If additional defects become apparent after disassembly or testing, we may provide a revised recommendation or estimate before proceeding.

12. Parts, Merchandise & Manufacturer Warranties

Replacement parts and products are subject to manufacturer availability, compatibility, discontinuation, shipping times, and warranty terms. We may use manufacturer-authorized, original-equipment, aftermarket, or functionally compatible parts when appropriate and disclosed.

Special-order, installed, used, electrical, gas-control, custom, or non-returnable manufacturer items may not be eligible for return. Eligible merchandise returns, if any, are subject to the return terms disclosed at purchase and applicable law.

Manufacturer warranties are provided by the manufacturer, not by Pro Grill, unless we expressly state in writing that a separate Pro Grill warranty applies.

13. Grill Sales, Replacement & Installation

Built-in grill replacement can depend on cutout dimensions, ventilation, clearances, fuel type, utility configuration, surrounding construction, code requirements, manufacturer specifications, and site conditions. Measurements and recommendations are based on conditions reasonably visible at the time.

Island modification, carpentry, masonry, electrical work, plumbing, gas-line alteration, permitting, code correction, structural repair, or other trade work is not included unless specifically stated in writing. Certain work may require a properly licensed third-party contractor.

14. Pre-Existing Conditions, Corrosion & Fragile Components

Outdoor grills are exposed to heat, grease, moisture, salt air, weather, pests, and age. Components may be rusted, brittle, corroded, seized, fatigued, deteriorated, or already near failure before we touch them.

We use reasonable care, but handling, cleaning, disassembly, testing, or normal service may reveal or cause an already deteriorated component, fastener, tile, grout joint, finish, wire, hose, igniter, burner, bracket, trim piece, or other item to crack, separate, crumble, fail, or become unusable.

Important: To the extent permitted by law, Pro Grill is not responsible for failure or damage caused by pre-existing deterioration, corrosion, hidden defects, improper prior installation or repair, manufacturer defects, ordinary wear, pest damage, or conditions that were not reasonably observable before service.

15. Appliance & Gas Safety

Outdoor cooking equipment involves heat, flame, combustible materials, fuel, electricity, and other risks. Follow the grill manufacturer’s instructions and applicable safety requirements. Do not operate a grill that smells of gas, leaks fuel, has damaged gas components, or otherwise appears unsafe.

If we identify a condition we reasonably believe presents a safety concern, we may stop work, leave an appliance off, recommend that it not be used, and/or recommend evaluation by an appropriate licensed professional. Cleaning or repair by Pro Grill does not eliminate the owner’s responsibility to operate and maintain the appliance safely.

16. Service Photos, Documentation & Records

We may photograph or record the grill, appliance components, outdoor kitchen, work area, serial/model information, and completed work for legitimate business purposes such as estimating, technician coordination, service records, quality control, warranty support, training, dispute resolution, and documenting pre-existing or completed conditions.

We will not use identifiable images of you for advertising or promotional purposes without permission when such permission is required. Our handling of personal information is addressed in our Privacy Policy.

17. Calls, Text Messages & Email

By providing contact information, you authorize us to contact you about your inquiry, appointment, estimate, purchase, service, account, payment, or other transaction using reasonable channels such as phone, text, and email. Message and data rates may apply.

Marketing communications are subject to applicable law and any consent required at the time of enrollment. Consent to receive marketing communications is not a condition of purchasing services where prohibited by law. You may opt out of marketing text messages by replying STOP and may use the unsubscribe link in marketing emails. Transactional or service-related communications may continue when reasonably necessary to complete or administer a transaction you requested.

18. Accounts, Passwords & Security

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account. Notify us promptly if you believe your account or credentials have been compromised. You may not access another person’s account without authorization.

19. Privacy

Our collection, use, disclosure, and retention of personal information is governed by our Privacy Policy. Where applicable, privacy choices and opt-out rights will also be described in our privacy notices and related request pages.

20. Intellectual Property

The website and its original text, graphics, photographs, videos, logos, layout, design, software, and other content are owned by or licensed to Pro Grill and are protected by applicable intellectual-property laws. Except as expressly permitted, you may not reproduce, republish, distribute, modify, commercially exploit, or create derivative works from our content without prior written permission.

Third-party brand names, product names, logos, and trademarks belong to their respective owners. Reference to a manufacturer or product does not imply sponsorship or endorsement unless expressly stated.

21. Reviews, Feedback & User Submissions

If you voluntarily submit a review, testimonial, photo, feedback, suggestion, or other content for publication, you represent that you have the right to submit it and that it does not violate another person’s rights or law. You grant Pro Grill a nonexclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt that submitted content for the purpose for which it was provided, including marketing where reasonably understood from the submission context.

This section does not apply to confidential payment information, private service communications, job applications, or materials that are not reasonably submitted for publication.

22. Third-Party Websites, Payment Providers & Services

Our website may link to or integrate with third-party services such as payment processors, financing providers, scheduling tools, maps, review platforms, social networks, or manufacturer websites. Those third parties may have their own terms and privacy practices. Pro Grill is not responsible for third-party websites or services that we do not control.

23. Website & Service Disclaimers

Website content is provided for general information and may not reflect every appliance, installation, local code, manufacturer requirement, or field condition. Online articles, videos, troubleshooting information, and other educational content are not a substitute for an on-site professional evaluation when one is appropriate.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY WE PROVIDE AND RIGHTS THAT CANNOT LEGALLY BE WAIVED, WE DISCLAIM IMPLIED WARRANTIES ARISING FROM WEBSITE USE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the website will always be uninterrupted, error-free, secure, or free from harmful code.

24. Limitation of Liability

To the maximum extent permitted by law, Pro Grill and its officers, employees, agents, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost data, loss of use, or similar losses, arising from the website or a service transaction, even if advised that such damages were possible.

To the maximum extent permitted by law, Pro Grill’s aggregate liability arising from a particular service, product, or transaction will not exceed the amount you paid Pro Grill for the specific service, product, or transaction giving rise to the claim.

These limitations do not exclude or limit liability that cannot lawfully be excluded or limited, including liability to the extent caused by gross negligence, willful misconduct, fraud, or other non-waivable liability under applicable law.

25. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Pro Grill and its officers, employees, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the website, your material breach of these Terms, your violation of another person’s rights, or content you submit for publication. This obligation does not require you to indemnify Pro Grill for Pro Grill’s own negligence or misconduct to the extent prohibited by law.

26. Dispute Resolution; Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. It affects legal rights, including the right to have certain disputes decided by a court or jury.

26.1 Informal Resolution First

Before filing arbitration or a lawsuit (other than an urgent request for temporary injunctive relief), the party raising the dispute must give the other party written notice describing the dispute and requested relief and allow at least 30 days to attempt an informal resolution.

26.2 Agreement to Arbitrate

Except for matters described below, you and Pro Grill agree that disputes arising out of or relating to these Terms, the website, a booking, product, payment, estimate, service, repair, installation, communication, or transaction with Pro Grill will be resolved by binding individual arbitration rather than in court.

This arbitration agreement is governed by the Federal Arbitration Act to the extent applicable. For consumer matters, arbitration will be administered by the American Arbitration Association (“AAA”) under its then-current Consumer Arbitration Rules. For business-to-business matters that do not qualify as consumer disputes, the AAA Commercial Arbitration Rules will apply. If AAA is unavailable, the parties will attempt to agree on a comparable neutral arbitration provider, or a court of competent jurisdiction may appoint one where permitted.

26.3 Location, Format & Fees

Consumer arbitration may be conducted by documents, telephone, video conference, or at a reasonably convenient location as allowed by the applicable rules. Arbitration fees will be allocated as required by applicable law and the governing arbitration rules. Pro Grill will pay fees that the governing rules or law require the business to pay.

26.4 Small Claims & Non-Waivable Relief

Either party may bring an individual claim in a court of competent jurisdiction that qualifies as small claims. Nothing in these Terms waives a right to seek public injunctive relief or any other remedy that applicable law provides cannot be waived or required to be arbitrated.

26.5 Individual Proceedings Only

TO THE EXTENT PERMITTED BY LAW, YOU AND PRO GRILL AGREE THAT CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION.

If a court determines that a particular claim or request for relief cannot lawfully be subject to this waiver, only that claim or request for relief will proceed in court after all arbitrable matters are resolved, unless applicable law requires otherwise.

26.6 Jury-Trial Waiver

FOR DISPUTES SUBJECT TO ARBITRATION, YOU AND PRO GRILL WAIVE THE RIGHT TO A TRIAL BY JURY.

26.7 Arbitration Opt-Out

You may opt out of this arbitration agreement by mailing a written notice within 30 days after first becoming bound by these Terms. The notice must include your name, mailing address, phone number or email used with Pro Grill, and a clear statement that you are opting out of arbitration under the Pro Grill Terms of Use & Service. 26.8 Governing Law & Court Venue

Except for the Federal Arbitration Act and any non-waivable law that applies to you, these Terms are governed by the laws of the State of California without regard to conflict-of-law rules. For disputes that are not subject to arbitration and are not properly brought in small claims court, the parties consent to the jurisdiction of state or federal courts located in Orange County, California, except where applicable law requires a different venue.

27. Changes to These Terms

We may revise these Terms from time to time. The “Last Updated” date will identify the most recent version. Changes apply prospectively when posted or when otherwise communicated as required by law. Material changes to an existing recurring service or other ongoing contractual relationship will be handled in accordance with the applicable agreement and law.

28. General Terms

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law. Our failure to enforce a provision is not a waiver of the right to enforce it later. You may not assign your rights under these Terms without our consent, but we may assign these Terms in connection with a merger, reorganization, sale of assets, or transfer of the applicable business, subject to law.

Headings are for convenience only. “Including” means “including without limitation.” Electronic records, approvals, signatures, and communications may be used to the extent permitted by law.

These Terms, together with any applicable estimate, work order, invoice, booking terms, membership terms, product terms, or other specific written agreement, constitute the applicable agreement between you and Pro Grill concerning the subject matter they cover.
